S.4569 TAKE IT DOWN Act
Senator Ted Cruz (R-TX) introduced and sponsored the TAKE IT DOWN Act (S.4569) with 19 cosponsors on June 18th, 2024. The bill was intended to combat the spread of non-consensual intimate imagery, including content generated by artificial intelligence like deepfake pornography.
The Act criminalizes non-consensual intimate imagery, making it a federal crime to publish or distribute. This includes both real and AI-generated images and videos that are shared without the consent of the person depicted.
Further, it would require social media companies and websites to implement procedures to remove non-consensual intimate imagery when they receive notification from victims. This legislation would place the responsibility on platforms to prevent the spread of harmful content.
Finally, the legislation provides a framework through which victims of non-consensual intimate imagery could always have the material removed and the offenders held accountable.
With wide support, the TAKE IT DOWN Act is meant to impede the growing misuse of AI in creating harmful digital content. On July 31st, 2024, the Committee on Commerce, Science, and Transportation ordered the legislation to be reported with an amendment and viewed the legislation favorably.
