H.R.9828 End the Vaccine Carveout Act

Representative Paul Gosar (R-AZ-9) introduced and sponsored the End the Vaccine Carveout Act with 30 cosponsors on September 25, 2024. This bill aims to remove the legal protections that shield vaccine manufacturers from liability for vaccine-related injuries.

These strong protections for vaccine manufacturers were established by the 1986 National Childhood Vaccine Injury Act, which prevented individuals from suing vaccine manufacturers in the vast majority of cases. Instead, injury claims are directed to the Vaccine Injury Compensation Program (VICP), which limits the ability of individuals to pursue civil lawsuits against manufacturers.

If passed, vaccine manufacturers would no longer be immune from civil lawsuits for injuries caused by vaccines. This includes all forms of vaccines.

The bill correctly acknowledges the conflicts of interest between federal agencies like the CDC and vaccine manufacturers: some agency employees hold patents or financial interests in vaccines they regulate.

Supporters argue that the bill would provide justice to individuals injured by vaccines and hold pharmaceutical companies accountable. Opponents believe that this bill could undermine public health efforts by discouraging vaccine development due to manufacturers' fears about litigation.
